Liability Insurance
Liability cover can be quite a complicated affair, and can include several different types of cover to insure against different situations, even where you might think you are not actually liable.
For instance, many people think Public Liability is a legal requirement. It isn’t, but Employer’s Liability is, which generally comes only as an add-on option to Public Liability, although it’s still a very good idea to take Public Liability cover to protect yourself.
Employer’s Liability is also a very grey area, complicated by the legal definition of employee, which often includes sub contractors, depending on how you contract work out to them, and whether they are “Labour only”, where they use your equipment, or “Bona Fide” where they use their own tools and materials. On top of all this, sometimes contingent liability is required, which provides liability where there is no obvious negligence or fault, an example of this would be where a building contractor takes a JCT 21.2.1 to protect other buildings which are near his site of works.
Liability cover isn’t just for building contractors either, Products Liability is available with most policies, so if you work in Retail, it can be handy covering you against faulty goods. This can be especially important if you sell food and drink.
